Gray Ritter Graham Files Dicamba Class Action Lawsuit on Behalf of Missouri Farmers

Gray Ritter Graham has filed a class action lawsuit on behalf of Missouri farmers who have suffered economic damages due to Monsanto’s decision to commercialize dicamba resistant seeds without a safe formulation of the dicamba herbicide to spray over the top of plants grown from those seeds.   All current versions of dicamba are prone to move off target.   State universities have determined that over 3.6 million acres of soybeans nationwide were reported to have been damaged in 2017 by off-target movement of dicamba.  Missouri had the second largest number of dicamba related complaints.

The lead plaintiffs in the litigation are McIvan Jones Farms in Mississippi County, Mo., and Steve and Vickie Jackson, partners of V&S Jackson Farms in Dunklin County, Mo.  Both farms grow soybeans. Dicamba is a herbicide that kills non-resistant soybeans and cotton, as well as certain weeds, and that has a propensity to volatilize and move off target. The lawsuit alleges that over-the-top applications of dicamba moved onto the farms’ soybean crops, damaging them significantly, and that Monsanto is liable for the resulting economic losses the farms suffered.

GRG attorney Don Downing is the lead GRG attorney on this litigation.  As co-lead counsel in 2011 he negotiated a $750 million settlement with Bayer Cropscience on behalf of rice farmers and working with other co-lead counsel in June 2017 won a $217.7 million verdict for corn farmers against Syngenta over its genetically modified corn seed.
