The United States Court of Appeals for the Eighth Circuit on May 11 ruled in favor of Gray Ritter Graham’s plaintiff clients in their appeal of a previous U.S. District Court, Eastern District of Missouri ruling in a breach-of-contract lawsuit. In that lawsuit, GRG argued that an insurance company owed its insured (GRG’s Clients) a defense and indemnity. The insurance company claimed, despite being paid the required premiums, it did not owe a defense and indemnity. Although the trial court originally sided with the insurance company, the Eighth Circuit Court of Appeals did not. In its short and well-written opinion the Appellate Court found, consistent with GRG’s arguments, that the insurance policy was ambiguous and that the ambiguity in the policy had to be read in favor of GRG’s clients and that the lawsuit can proceed.
