For more than 25 years Paul Beverage Company, Inc. distributed Dr. Pepper products in an exclusive territory in the greater St. Louis metropolitan area pursuant to a distributorship agreement with Kuerig Dr. Pepper. In 2017 Dr. Pepper terminated the distributorship. Paul Beverage sued the American Bottling Company (the predecessor to Kuerig Dr. Pepper) for breach of contract in the United States District Court for Eastern Missouri.
On Friday, August 16, 2019, after a five-day jury trial before the Honorable Jean Hamilton, a jury agreed with Paul Beverage and awarded monetary damages for breach of contract in the amount of $3.3 million. Paul Beverage was represented in the trial by Morry Cole and Jason Sapp, of Gray, Ritter and Graham, P.C.
“Mark and Georgia Paul are grateful to have had the opportunity to present their case for their family-owned business to an attentive and conscientious jury,” said the Paul’s lead attorney Morry Cole. “Paul Beverage has operated in the St. Louis area since 1942 and has always been a great member of the community,” said Cole. Cole continued, “Now that the trial is over, the Pauls look forward to continuing to have a positive influence in St. Louis and Jefferson Counties long into the future.”
