$7.5 Million Settlement Reached in Organic Milk Class Action Lawsuit
A settlement of $7.5 million was reached with Aurora Organic Dairy in a class action lawsuit over the company’s milk products. Gray Ritter Graham attorney Don Downing was co-lead counsel for the plaintiffs and alleged that Aurora, which supplies organic milk to Wal-Mart, Target, Wild Oats, Costco, and other retailers, failed to adhere to USDA organic standards while labeling its milk as organic. The cost of organic milk is significantly higher than non-organic milk.
Gray Ritter Graham attorney Gretchen Garrison also was instrumentally involved in the case, including amending the master complaint after reversal of dismissal on preemption grounds by the Eighth Circuit, briefing in opposition to a post-appeal motion to dismiss, approval of class settlement, and appeal.
